Terms of Service

1. Acceptance of Terms

By creating an account on or otherwise accessing Velvet Palace ("the Platform"), operated by Velvet Palace / Emporo Services ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the Platform.

These Terms constitute a legally binding agreement between you ("User", "you", "your") and Velvet Palace. We reserve the right to update or modify these Terms at any time. Continued use of the Platform following any changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age to use the Platform. By registering, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. We reserve the right to request proof of identity and age at any time, and to suspend or terminate accounts where eligibility cannot be verified.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current, and complete information during registration. You are solely responsible for all activity that occurs under your account. If you suspect unauthorised access, you must notify us immediately.

4. User Content

You retain all ownership rights to the content you upload to the Platform ("User Content"). By uploading content, you grant Velvet Palace a non-exclusive, worldwide, royalty-free licence to host, display, and distribute your content solely for the purposes of operating the Platform and providing the services described herein.

You represent and warrant that you have all necessary rights, licences, and consents to upload and distribute your content, and that your content does not infringe upon the rights of any third party.

5. Prohibited Content and Conduct

You agree not to use the Platform to:

  • Upload, distribute, or promote content involving minors in any capacity;
  • Upload content depicting non-consensual acts or any form of coercion;
  • Engage in fraud, impersonation, harassment, or any unlawful activity;
  • Distribute malware, spam, or any material intended to disrupt the Platform;
  • Violate any applicable local, national, or international law or regulation;
  • Circumvent, disable, or otherwise interfere with security-related features of the Platform.

Violation of these prohibitions may result in immediate account termination and, where appropriate, referral to law enforcement authorities. Please refer to our Acceptable Use Policy for detailed guidelines.

6. Payments and Fees

Velvet Palace does not charge monthly subscription fees. We earn revenue through a commission on each completed sale made through the Platform. The applicable commission rate will be clearly communicated to you before any transaction. Payouts are processed through PayPal. By using the Platform to sell content, you agree to the applicable payment terms.

All prices displayed are set by the content creator. We are not responsible for pricing disputes between creators and buyers.

7. Refunds and Disputes

Due to the digital nature of content sold through the Platform, refunds are generally not available once content has been accessed or downloaded. Buyers should review content descriptions carefully before purchasing. In cases of fraud or technical failure, disputes should be directed to our support team.

8. Intellectual Property

The Platform, including its design, code, branding, logos, and documentation, is the intellectual property of Velvet Palace and is protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without our prior written consent.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Velvet Palace shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of profits, loss of data, or business interruption, arising out of or in connection with your use of the Platform.

We do not guarantee uninterrupted or error-free operation of the Platform. We provide the service "as is" and "as available" without warranties of any kind, whether express or implied.

10. Indemnification

You agree to indemnify, defend, and hold harmless Velvet Palace, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform, your content, or your violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Platform ceases immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and, where applicable, the laws of the Netherlands. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Netherlands, without prejudice to the mandatory consumer protection provisions of your country of residence under EU Regulation 593/2008 (Rome I).
